New York State Lemon Law?
Hello I bought a 2000 suzuki from a buy here pay here dealership with 50,000 miles on it on about 4/20 of this year. Ive since put about 5000 miles on it and have run into some problems. The car had these same problems when I bought the car but not as severe as they have become in the past months. I brought the car in weeks after buying it and they simply brushed it off and said it would be alright and that its an older car, although they did supposedly do a thorough inspection. They are being very uncooperative about it now and i was just wondering if anyone could explain the NY state lemon law to me and if i have any shot whatsoever at getting my money back. - No, actually you're stuck. The Lemon Law(s) doesn't cover a 9-year old vehicle. Only new cars are covered, with some used cars covered in certain states and the one caveat being that they MUST still be under the original manufacturer's warranty. Also, as it comes up often, there is no return period in car sales. Not 3 days, not 30 days. Once you sign and drive off, it's yours. Your only hope is that the dealer will work with you on any type of repair. However, by law, they do not have to. Lesson learned... never trust a seller's word at face value, always get a thorough inspection performed by a licensed mechanic beforehand. It's not a guarantee per se, but will go far to expose apparent issues.
- NY state lemon law If your BRAND NEW car has to go to the shop 4 times for the SAME PROBLEM and they cant fix it, you MIGHT have a case if you hire a lawyer to argue for you. If you bought a 9 year old car, it was yours the minute you signed the paperwork. uncooperative ? Imagine that. They sold a car as is and you expect them to fix everything.
